Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Moody Chart Calculator mobile application ("the App", "we", "us", or "our"). Please read these Terms carefully before using the App.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not download, install, or use the App. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of the App

The App is a calculator tool that computes pipe flow friction factors using the Moody chart and related correlations. It is intended for educational and professional reference purposes only.

3. Disclaimer of Warranties

We do not guarantee that calculations produced by the App are accurate, complete, current, or suitable for any particular use. The App is not a substitute for professional engineering judgment. You are solely responsible for independently verifying any result before relying on it for any design, safety-critical, regulatory, financial, or other consequential application.

4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will we, our affiliates, or our licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses, arising out of or related to your use of, or inability to use, the App or its results — even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the App or these Terms will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $25.00. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions our liability is limited to the maximum extent permitted by law.

5. Subscriptions and Payments

• Billing: The App offers optional subscriptions billed through the Apple App Store or Google Play Store at the price disclosed at the time of purchase.
• Auto-renewal: Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Cancellation: You can manage and cancel subscriptions at any time through your App Store or Google Play account settings. Uninstalling the App does not cancel an active subscription.
• Refunds: Refunds are handled by Apple or Google in accordance with their respective policies. We generally do not issue refunds directly. To request a refund, contact Apple or Google through your purchase history.
• Price changes: Subscription prices may change. Material price changes will be communicated in accordance with the rules of the applicable app store, and your continued subscription after the change takes effect constitutes acceptance of the new price.
• Free trials: If a free trial is offered, you must cancel before the trial ends to avoid being charged. Only one trial per user is permitted unless otherwise stated.

6. Acceptable Use

You agree not to, and not to permit anyone else to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent that applicable law expressly permits despite this limitation.
• Circumvent, disable, or interfere with any security, licensing, payment, or rate-limiting features of the App.
• Use the App for any unlawful, infringing, harmful, or fraudulent purpose, or in violation of any applicable law or regulation.
• Resell, redistribute, sublicense, lease, or rent the App or any portion of it.
• Use automated means to access or scrape data from the App.
• Remove or alter any proprietary notices contained in the App.

7. Intellectual Property

The App and all its content, including without limitation software, design, text, graphics, logos, icons, images, formulas, layouts, and trademarks, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal or internal business use. All rights not expressly granted are reserved.

8. Third-Party Services and Stores

The App is distributed through, and may rely on services provided by, third parties, including Apple and Google. Your use of those services is subject to their separate terms. These Terms are between you and us only — not with Apple or Google. Apple and Google have no obligation to provide maintenance or support for the App.

9. Updates and Availability

We may release updates, modify, suspend, or discontinue the App (or any feature) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

10. Termination

These Terms remain in effect until terminated. We may suspend or terminate your access to the App at any time if you breach these Terms or if we discontinue the App. You may terminate these Terms at any time by uninstalling the App and canceling any active subscription. Sections that by their nature should survive termination (including disclaimers, limitations of liability, intellectual property, and governing law) will survive.

11. Changes to These Terms

We may modify these Terms from time to time. When we do, we will update the "Last updated" date above. Material changes will be communicated through the App or our store listings. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of laws principles. To the extent permitted by law, any dispute arising out of or relating to these Terms or the App will be resolved exclusively in the state or federal courts located in the United States. Nothing in this section limits any non-waivable rights you may have under the consumer protection laws of your country of residence.

13. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and any in-app disclosures, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
